Finance Minister Nirmala Sitharaman had announced the introduction of a new income law in the general budget soon and its draft has been presented in Parliament. In this new law, the powers given to the officers of the Income Tax Department have been further increased. During the investigation, the officers will be able to search every digital information including the taxpayer’s computer, phone, email, internet media account.
In fact, Section 132 of the Income Tax Act 1961, which is currently in force, also gives the authorities the power to break lockers, break doors, seize goods and inspect the relevant file on suspicion of tax evasion or concealment of assets. But at that time, digital files were not prepared, so the new law, which will come into force from April 1 next year, gives the authority to inspect and view every digital content. This new law is being brought to make the six-decade-old law short, modern and simple. According to the new Income Tax Act, 2025, the department officials will be able to conduct a complete search of taxpayers’ email servers, online investment accounts, trading and bank accounts, internet media accounts, digital application servers and other things during the investigation or search.
